Thank you for booking your hiking tour with Trenoza Treks LLC (“Trenoza Treks”, “we”, “our”, or “us”). Please review the following terms carefully. By purchasing a tour from us or by participating in a tour, you signify your agreement to these Terms of Service. If you do not agree to these Terms of Service, you may not participate in a Trenoza Treks tour.
Trenoza Treks respects the privacy of its participants. Please refer to our Privacy Policy, found at trenozatreks.com/privacy, which explains how we collect, use, and disclose information that pertains to your privacy. When you access or use our services, you signify your agreement to this Privacy Policy.
Trenoza Treks provides a marketplace where travelers can book hiking and trekking tours throughout Europe.
As a condition of your participation on a tour, you warrant that:
Trenoza Treks may contract with independent contractors to provide transportation, accommodation services, guide services and/or all other related tour services. We assume no responsibility, however caused, for injury, loss, or damage, to person or property in connection with any service provided by an independent contractor, or resulting directly from the following force majeure events or other events beyond our control, including, but not limited to, weather issues, failure of any means of transportation to arrive or depart as scheduled, changes in transportation or accommodations, or any other independent contractor services over which we have no control.
All guides leading Trenoza Treks tours are Alpine mountain guides, fully qualified for leading trekking groups worldwide. Guides have extensive knowledge of the mountain environment, including plants, animals, local history and geology. We ensure our tour groups small enough that a guide can comfortably manage the group. They are experienced professionals and are used to dealing with diverse groups. The guide’s primary role is managing your safety in the mountains during the tour and their emphasis will be towards the group, rather than individuals’ needs.
We reserve the right to make reasonable changes in the itinerary where deemed advisable for the comfort and well-being of tour participants.
A refundable deposit of $400 USD per traveler, or 15% of the total trip cost, whichever is the greater, is required at time of booking to secure your space. Full payment is required 60 days before your departure date. All payments are processed in the United States and to be received in USD. Payment may be made by credit card (Visa, Mastercard, American Express, Discover, AND Diners Club) via our STRIPE secure online payment provider.
Payments may also be made via SWIFT/IBAN bank transfer in Europe, to our EURO denominated account. The amount deposited by you must be the equivalent USD amount and will be determined fairly by the average mid-market rate. The amount will be valid for a limit period of up to 36 hours for you to initiate the transfer. (for example: https://wise.com/gb/currency-converter/usd-to-eur-rate?amount=400
Trenoza Treks will not charge any additional fee for processing your payments however, refunds will be subject to a 3% transaction fee charged by our provider. Some banks and credit card companies impose fees for cross border transactions and currency conversion. If you have any questions about these fees or exchange rates, please contact your bank.
If you decide to cancel your tour, the following fees’ schedule will be applied from the date of receipt of your cancellation:

Remaining unpaid due portions of tour fees (owing to late payments) will remain due and need to be settled after cancellation. Trenoza Treks does not give any refunds for unused hotel rooms, meals, sightseeing trips, or tour arrangements. The tour price is quoted as a package; no refunds or credits are given for unused services.
You will be advised at the time of booking of the current status of the tour, with regards to the minimum number of participants. This will help you decided whether it is appropriate for you to make other necessary travel arrangements and bookings (e.g. flights to and from the tour pick-up/drop-off locations). Trenoza Treks reserve the right to cancel any tour where the minimum number of participants is not met. In this case a full refund of the tour fees advanced will be given. Note however, Trenoza Treks is not responsible for exterior expenses incurred by you in preparing for the tour (e.g., non-refundable air tickets, visa fees if applicable, gear or medical expenses). We also reserve the right to cancel all or a portion of a tour for a force majeure event or any other circumstances beyond our control and, in the event of such cancellation, full or partial refunds, if any, will be at Trenoza Treks’ sole discretion.
If you are unable to procure the necessary travel documents (e.g. passport, visa) to travel to the tour destination, or if your travel documents are invalid or unavailable to use for the required travel, your participation in the tour will be cancelled. Trenoza Treks reserves the right to retain the fees collected from you in connection with the tour, subject to the fees’ schedule above. If you disregard or are in violation of the laws of the jurisdictions in which the tour takes place, you will be removed from the tour and may be subject to prosecution by local or federal authorities. In such an event, you will be responsible for any and all costs incurred in connection with your unlawful activities. You will not be entitled to a refund of the tour. Trenoza Treks reserves the right to recover from you any costs incurred as a result of your unlawful activities. Trenoza Treks reserves the right, at our sole discretion, to decline, accept, or remove any person as a tour participant should such person’s behavior, health, or mental condition impede the operation of the tour. You will not be entitled to a refund of the tour. Trenoza Treks reserves the right to recover from you any costs incurred as a result of your exclusion.
We require all of our tour participants to have travel insurance for the entire period of the tour, including start and end dates. Please note that your regular health, homeowners, or other forms of personal self-insurance may not cover you for the travel activities contemplated herein. As such, valid proof of travel insurance must be provided to Trenoza Treks prior to the start of any tour. As a minimum your travel insurance must include coverage for costs associated with: helicopter evacuation, search and rescue, medical and repatriation; adequate for hiking activities accompanied by a guide to the maximum altitude listed in the itinerary (notionally 3000 m / 9850 ft or less). To provide greater protection for our participants, we also recommend you select travel insurance which covers costs associated with cancellation of the tour and costs due to flight cancellations or delays, and lost or stolen luggage. Trenoza Treks is not responsible to you or any tour participant for any costs incurred from but not limited to: delayed or canceled flights, or damaged, lost, or stolen passports, luggage, money, or other personal items.
You have chosen to participate in the above referenced tour (hereinafter referred to as the “Tour”), which is organized by Trenoza Treks. You understand that:
You hereby freely assume the above-mentioned risks and any harm, injury or loss that may occur to you or your property as a result of your participation in the Tour, including any risks caused by the negligence of Trenoza Treks, its employees and officers, its contractors, and other Tour participants.
You hereby WAIVE AND RELEASE ALL LIABILITIES, CAUSES OF ACTION, CLAIMS AND DEMANDS against Trenoza Treks, its employees, officers, directors, vendors and contractors (“Released Parties”), where such LIABILITIES, CAUSES OF ACTION, CLAIMS AND DEMANDS arise in any way from any injury, death, loss or harm (whether foreseen or unforeseen) that occur to you or to any other person or to any property during the Tour or are in any way related to the Tour. This release includes, but is not limited to, claims for the negligence of the Released Parties and claims for strict liability for abnormally dangerous activities. This release does not extend to claims for gross negligence, intentional or reckless misconduct, or any other liabilities that Washington law does not permit to be released by agreement. You also agree NOT TO SUE or make a claim against the Released Parties for death, injuries, loss, or harm that occur on the Tour.
You promise to INDEMNIFY, WARRANT, HOLD HARMLESS AND DEFEND the Released Parties against any and all LIABILITIES, CAUSES OF ACTION, CLAIMS AND DEMANDS that arise from your acts or your failure to act (including your own negligence) during or relating to the Tour. In accordance with this promise, you will reimburse the Released Parties for any damages, reasonable settlements and defense costs, including attorney’s fees, that they incur because of any such claims made against them. You agree that in the event of your death or disability, the terms of this agreement, including the indemnification obligation in this release, will be binding on your estate, and your personal representative, executor, administrator or guardian will be obligated to respect and enforce them.
You have carefully read the Tour materials provided by Trenoza Treks, and have familiarized yourself with all of the information provided to you about the Tour, its related activities, its difficulty level, and potential harm. You acknowledge that Trenoza Treks has no control over and assumes no responsibility for the actions of any independent contractors providing any services for the Tour.
You agree that the purpose of this release is that it shall be an enforceable release of liability and indemnity as broad and inclusive as is permitted by Washington law. You agree that if any portion or provision of this agreement is found to be invalid or unenforceable, then the remainder will continue in full force and effect. You also agree that any invalid provision will be modified or partially enforced to the maximum extent permitted by law to carry out the purpose of the agreement.
BY PROVIDING TOUR BOOKING SERVICES IN PARTICULAR INTERNATIONAL DESTINATIONS, TRENOZA TREKS DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH AREAS IS ADVISABLE OR WITHOUT RISK, AND IS NOT LIABLE FOR DAMAGES OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS.
This agreement is governed by and shall be construed in accordance with the laws of the state of Washington, without any reference to its choice of law rules. You agree that any dispute arising from this Agreement or in any way associated with the tour shall be brought in the Superior Court of King County, Washington, or in the U.S. District Court for the Western District of Washington, and you agree to the jurisdiction and venue of those courts for any such dispute. In any litigation in which the validity or enforceability of this agreement is contested, you agree that the prevailing party will pay all attorney's fees and costs of the parties seeking to uphold the agreement. You have fully informed yourself of the contents of this agreement by reading it before agreeing to it. No oral representations, statements or other inducements to agree to this release have been made apart from what is contained in this document.
